These are set out in the Byelaws of the CPD Awards.
THE CPD AWARDS – MEMBERSHIP TERMS AND CONDITIONS
1. INTRODUCTION:
1.1. Members (only institutions/organizations) must be responsible for all their work and make sure that people working under them are capable of doing their assigned tasks. They should treat their employees fairly and give them equal opportunities. They must also take responsibility for the work done by those under their authority.
1.2. Members should make efforts to keep up with new developments in their profession and work on improving their professional skills. They should also encourage their employees to do the same. If required, they must follow the Institution’s Continuing Professional Development (CPD) scheme.
1.3. Members must always maintain the reputation of their profession and follow the rules of the institution. If a member is found guilty of misconduct, they may face disciplinary action by the Institute. Misconduct includes not following the institution’s rules or being found guilty of an offense relevant to membership. The Institute will have procedures for handling complaints against members, ensuring fairness and human rights. They may also publish details of disciplinary actions taken.
1.4 All members accept certain on-going responsibilities associated with membership.
2. BECOMING A MEMBER
2.1 If you want to join the CPD awards as a member, you need to fill out a form and pay the fees. The CPD awards will let you know if your application is accepted. Only businesses and organizations can join, not individuals. If anything changes in your organization, you have to tell the CPD awards. You have to renew your membership every year and pay the fees again. If you want to cancel or get a refund, it’s up to the CPD awards to decide.
3. OUR LIABILITY
3.1 To the fullest extent permitted by law, we, the Company, and any third parties connected to us:
(a) shall not be liable to you, the Member, for any costs, expenses, loss or damage (whether direct, indirect or consequential, and whether economic or other) arising from your exercise of any membership or other rights granted to you under these Conditions;
(b) hereby expressly exclude all conditions, warranties and other terms which might otherwise be implied by statute, common law or equity.
3.2 Nothing in these Conditions shall have the effect of excluding or limiting any liability for death or personal injury caused by negligence or for fraud.
3.3 Subject to clauses 3.1 and 3.2, our aggregate liability to you in respect of claims arising out of or in connection with these Conditions or any collateral contract, whether in contract or tort (including negligence) or otherwise, shall in no circumstances exceed 200% of the total Subscription Fee payable by you in the year in which the claim arises.
4. INDEMNITY
4.1 You, the Member, shall indemnify us, the Company, against all liabilities, costs, expenses, damages and losses (including any direct, indirect or consequential losses, loss of profit, loss of reputation, and all interest, penalties and legal and other reasonable professional costs and expenses) suffered or incurred by us arising out of or in connection with any breach of these Conditions by you, including (but not limited to) any breach of any provisions relating to the licensing of the Company’s Trade Marks or other intellectual property to the Member) or out of our use, review and accreditation of any our Materials.
5. CONFIDENTIALITY
5.1 Both parties agree not to share any confidential information about the other party’s business, customers, clients, or suppliers with anyone else unless both parties agree. Neither party will use the other party’s confidential information for anything other than fulfilling their responsibilities under these Conditions.
6. APPLICATION OF THE TERMS
6.1 When becoming a member of the CPD awards, it’s the duty of each member to understand and be aware of the responsibilities linked to the membership.
6.2 Failure to adhere to this Terms may amount to a direct contravention of the CPD awards’ terms for Members.
7. DISCIPLINARY PROCEEDINGS FOR MEMBERS
7.1The terms used in these Operational Procedures will have the same definitions as those in the Byelaws of the CPD awards, unless specified otherwise. An Appellant is a respondent appealing a decision made by a Disciplinary Committee. A Complainant is someone making a complaint against a member, which may also include the CPD awards. A Complaint encompasses any issue or concern brought to the attention of the CPD awards.
8. A COMPLAINT AGAINST A MEMBER
8.1 Any person may bring to the attention of the Chief Executive any facts or matters indicating that a member may have become liable to disciplinary action.
8.2 A member shall be under a general obligation of bringing to the notice of the Chief Executive any facts or matters indicating that another member may have become liable to disciplinary action.
8.3 Where a complaint against a member is made to the CPD awards or any fact or matter comes to the attention of the Chief Executive indicating that a member may be guilty of misconduct, the Chief Executive shall initiate disciplinary procedures
8.4 Where a case is referred to a Disciplinary Panel, the respondent shall be advised of the proposed date of hearing and of his rights
To make a submission in writing or in person
To be represented
To call and cross examine witnesses.
9. APPOINTMENT OF DISCIPLINARY PANEL
9.1 A Disciplinary Panel shall be appointed by the CPD awards Chief Executive
9.2 The three members of the Disciplinary Panel shall determine which of them shall be Chair.
9.3 The respondent shall have a right to appear before the Panel.

The options available include:
Giving a reprimand to the respondent and offering advice for future behaviour, which may include suggesting a specific course of action.
Revoking any membership privileges the respondent enjoys.
Terminating the respondent’s membership altogether.
11. COSTS
11.1 The Disciplinary Panel has the authority to demand that a respondent found guilty of misconduct cover the costs associated with the proceedings, which may include reimbursing expenses for any witnesses involved.
